The Site is operated by us, Viola&Vesper, a company registered in Turkey, residing at Cumhuriyet Mah. İncirli Dede Cad. No: 6 E Şişli/İstanbul (“we”, “us”, “our”), which provides an online facility through the Site where individuals can purchase the officially licensed merchandise of Viola&Vesper (the "Services").

These Terms refer to and incorporate the following additional Terms, which also apply to your use of this Site:

• Privacy Notice, which sets out the terms on which we process any personal data we collect about you or that you provide to us.
• Returns and Refunds, which lays out the terms of returning goods you purchase through the Site and refund of your payment.
• Distance Sale Contract, which provides for the terms governing our legal relationship with you specific to a purchase. 

By using the Services or visiting or browsing the Site, you accept these Terms and any modifications that may be made from time to time thereto. If you do not agree to these Terms, you should not use the Service or visit or browse the Site.

Use of Services

The Site is our exclusive property and all of its elements are protected by copyright, trademarks, or patents. The reproduction of all or part of the Site is considered counterfeit in the sense of the intellectual property law.

You agree to comply with all applicable laws and regulations in connection with your use of the Services and the Site. Products, Availability, and Prices

Product offerings are valid as long as they are visible on the website and in any case until the stock has run out. We do not guarantee in any way the availability of the products for sale during a precise period. The products offered for sale are presented and detailed with the greatest possible precision. However, the photographs of the products are for illustrative purposes. Please refer to Returns and Refunds for the terms governing the return of products.

The prices of the products are displayed in Euro/USD/TRY and includes VAT. There may be differences in our Turkish Lira and foreign currency (USD, EUR) pricing due to fluctuations and differences in exchange rates. We assume no responsibility for differences in our pricing at our local and international website for this reason. The EUR or USD price shown to you at our checkout page is to be deemed the actual price of your order.

The prices displayed exclude shipping. Shipping costs will be provided before the final confirmation of your order. The prices are valid as long as they are shown on the website. We reserve our right to change the price of any product as we see fit.

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

The product price and the exchange rate for payment may vary depending on the location. A customer residing in Turkey will be charged in Turkish Lira and customers residing elsewhere will be charged in EURO. If we detect any VPN usage when an item is bought, we have a right to cancel the order.

There may be custom tax and duty charges depending on the country of shipping. The customers residing outside of Turkey will be responsible for their own tax and duties they have to pay at the customs of their country to claim their order.

User Comments, Feedbacks and Other Submissions

If, at our request, you send certain specific submissions or without a request from us you send comments, creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'Comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any Comments that you forward to us. You agree that your Comments will not violate any third-party rights, including copyright, trademark, privacy, personality or other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Comments. Shipping

You must fill in carefully all the fields on the checkout page including your delivery address. Neither us nor our shipping service providers can be held liable for failure of delivery due to inaccuracy or error in the information you provided.

Except in cases of non-compliance or hidden defects, no claim and/or subsequent reservations can be directed at us after receipt of the products by you.

Content You Provide

We allow the users of our Site to post public reviews of the goods sold on the Site and may develop new features allowing users to post different types of content on the Site (the “Content”).

We will not be responsible or liable to you or any third party for the Content or accuracy of any Content posted by you or any other user of our Site.

You grant us a non-exclusive, irrevocable, perpetual, transferable, sub-licensable, royalty-free, unconditional, worldwide license to use, copy, distribute, display, and disclose to third parties any Content you submit to the Site.

Termination of Services

We have the right to disable any user account or prevent any user from accessing the Site or obtaining the Services from us, if we have reasons to suspect the account has been compromised or if in our reasonable opinion you have failed to comply with these Terms. We reserve the right to refuse any order from a customer with whom there is a dispute.

We may at our discretion, issue warnings, suspend, block, or terminate your access to the Site and/or the Services (or any part of them) or remove any Content uploaded, including without limitation, public user reviews, if:

We assume no responsibility for the content of websites linked on our Site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

You agree to indemnify us for any loss, liability, cost, or expense for any third-party claim arising from or connected to your misuse of the Site or Services or any use which is in breach of these Terms.

Dissatisfaction. In case of your dissatisfaction for any reason, you cannot claim any other compensation other than the reimbursement of your order, provided it qualifies for reimbursement under the Terms.

Force Majeure. We shall not be held responsible for the non-execution of a contract with you in the emergence of a case of force majeure especially those affecting postal services, carriers, and shipping services.

Miscellaneous

Severance. If any or any part of the terms contained in these terms shall be determined by any competent authority to be invalid, unlawful, or unenforceable to any extent, such term shall to that extent be severed from the remaining terms which shall continue to be valid and enforceable to the fullest extent permitted by law.

Entire agreement. These Terms and all documents referred herein constitute the entire agreement between us and you and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between us and you, whether written or oral, relating to its subject matter.

Dispute resolution. These Terms will be governed by and construed in accordance with Turkish law. The courts and enforcement offices of Istanbul shall have exclusive jurisdiction over any and all disputes that may arise in relation with these terms and conditions.

We may change these Terms from time to time by posting an amended version on this page. We recommend that you check this page from time to time, as your continued use of this Site after these Terms are amended shall mean that you agree to be bound by such changes.
